Privacy Policy

Effective November 3, 2026

At EMERGENTE we believe your data belongs to you. This policy explains what information we collect, why we use it, who we share it with, how long we keep it and what rights you have over it.

01 Who we are and scope

EMERGENTE LLC ("EMERGENTE", "we") is a limited liability company organized under the laws of the Commonwealth of Puerto Rico, with offices in Guaynabo, Puerto Rico. We are responsible for the personal information we handle under this policy.

This policy applies to emergente.net, our forms and contact channels (email, phone, messaging and meetings) and the information we handle while providing our services. It does not apply to third-party sites, which have their own policies.

02 Information we collect

Information you give us directly:

  • Contact details: name, company, email, phone and website.
  • Request details: services of interest, business size, estimated investment, timing, project description and preferred contact channel.
  • Certifications and consents: your age certification, your acceptance of these documents and your permission for us to contact you, with the date you gave them.
  • Client data: billing information, contracts, communications and the business information you provide for a project.

Information collected automatically: our hosting provider logs technical data such as IP address, browser type, pages requested and date and time, to run the site, prevent abuse and keep it secure. The site does not use advertising cookies, tracking pixels or third-party analytics tools.

Bot protection: the diagnostic form uses Cloudflare Turnstile, which analyzes technical signals from your browser and your IP address to confirm a person is submitting it. Cloudflare processes that data only for this check and we do not use it for any other purpose.

Information from public sources: to reach potential business clients we may use business contact details that companies publish (for example, on their website or in business directories). You can ask us to stop contacting you at any time.

Payments: payments are processed by specialized providers (such as Stripe and ATH Móvil Business). EMERGENTE does not receive or store full card numbers or banking credentials.

03 How we use your information

  • To answer your request, schedule the diagnostic and prepare proposals and quotes.
  • To provide the contracted services, support you and manage the business relationship.
  • To invoice, collect and meet legal, tax and accounting obligations, including those of the Puerto Rico Department of Treasury.
  • To send you communications about your request or service and, unless you have opted out, business information related to our services.
  • To protect the site and our systems: validating forms and detecting spam, fraud and misuse.
  • To improve our services using aggregated information that does not identify you.

We only use your information for these purposes or for compatible ones we tell you about first. We do not sell your personal information or share it for cross-context behavioral advertising.

04 Your business data is yours

When we handle information about your company or your customers to provide a service, we act as your service provider and follow your instructions. You own that information. Accordingly:

  • We use it only to provide the services agreed in your contract.
  • We do not sell it, use it for other clients or use it to train artificial intelligence models.
  • You can request a complete copy in open formats at any time.
  • When the relationship ends, we hand over your information and delete it from our systems within the agreed period, except what the law requires us to keep.

Specific ownership, access, delivery and deletion terms are set out in each project contract.

05 Use of artificial intelligence

We use third-party artificial intelligence services (such as Anthropic and Google) to research, draft and automate tasks. We contract them under business terms that do not allow the information we send to be used to train their models, and we send only the information each task needs.

A person on our team reviews the content that reaches our clients. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing.

06 Who we share your information with

We share information only in these cases:

  • Providers that help us operate, under confidentiality and security obligations and only to provide their services to us: site hosting and forms (Netlify), bot protection (Cloudflare), servers (Hostinger), email (Google Workspace and Postmark), meeting scheduling (Cal.com), databases (Supabase), payments (Stripe and ATH Móvil Business) and artificial intelligence (Anthropic and Google).
  • Authorities, when required by law, court order or valid legal process, or to protect the rights, safety or property of EMERGENTE, our clients or others.
  • A corporate transaction, such as a merger, acquisition or asset sale, in which the information would remain protected by this policy.
  • Any other case with your consent.

07 Communications and consent

With your permission we contact you by email or phone about your request or service, and by messaging when that channel is available.

Our marketing emails identify us, include our physical address and an unsubscribe link, as required by the federal CAN-SPAM Act. We honor unsubscribe requests within 10 business days.

We do not make marketing calls or send marketing text messages using automated systems or prerecorded voices without your prior express written consent, as required by the federal TCPA. That consent is not a condition of purchasing our services and you can withdraw it at any time by replying "STOP" or writing to us.

08 How long we keep your information

  • Requests that do not become a project: up to 24 months from the last contact.
  • Client information, contracts and invoices: for the length of the relationship and then as long as applicable tax, accounting and commercial laws require (generally up to 7 years).
  • Site technical logs: for short periods, according to our hosting provider’s settings.
  • Unsubscribe requests: we keep the minimum needed to honor your choice not to receive more messages.

When these periods end, we delete the information or anonymize it so it no longer identifies you.

09 How we protect your information

We apply reasonable administrative, technical and physical safeguards: encryption in transit (HTTPS/TLS), access limited to those who need it, two-factor authentication, validation of the data we receive, digital signatures between our systems, backups and activity logs.

No system is completely secure. If you suspect unauthorized use of your information, write to us right away.

10 Security incidents

If a security breach affects your personal information, we will notify you and the competent authorities, including the Puerto Rico Department of Consumer Affairs (DACO), as required by Puerto Rico Act 111-2005 and other applicable laws, within the deadlines they set. We will explain what happened, what information was affected and what we did about it.

11 Your rights

The Constitution of Puerto Rico protects your right to privacy. Wherever you live, you can ask us for:

  • Access: to know what information we hold about you and get a copy.
  • Correction: to update inaccurate or incomplete information.
  • Deletion: to erase your information, except what we must keep by law.
  • Portability: to receive your information in an open, commonly used format.
  • Objection and opt-out: to stop receiving marketing communications.
  • Withdrawal of consent: to withdraw a permission you gave us, without affecting what was done before.

To exercise your rights, write to the email in the contact section. We will verify your identity before responding and reply within 30 days; if we need more time we will tell you, without exceeding 45 days or the deadline set by the law that applies to you. You may act through an authorized agent. We will not treat you differently for exercising your rights.

If you live in a state with its own privacy laws (such as California), you also have the rights those laws grant to the extent they apply to us.

12 Browser privacy signals

We do not track your activity across sites. If your browser sends a Global Privacy Control signal, we treat it as a request not to sell or share your information, which is already our practice.

13 Minors

Our site and services are intended for businesses and adults. We do not knowingly collect information from anyone under 18 and, in compliance with the federal COPPA, never from children under 13. If we learn we have received it, we delete it.

14 Where your information is processed

We process and store information in Puerto Rico and the United States. If you contact us from another country, your information will be transferred to and processed in these jurisdictions under the protections of this policy.

16 Changes to this policy

We may update this policy. We will post the current version on this page with its effective date and, for material changes, notify our clients by email before they take effect.
